Terms of sale
These terms cover every order placed on this shop. Placing one means accepting them. They are written to be read; where the law says something in particular, we say it in particular.
1. Who you are dealing with
Ayman KACEMI, trading as Photo Motif — 19 rue Desdevises du Dézert, 63000 Clermont-Ferrand, France. Telephone +33 7 61 38 92 87, email contact@photomotif.com. The legal notice says the same in full.
2. What we sell
The restoration of one photograph you send us, in two forms:
- Restored photograph — your photograph restored and sent back as a high-resolution digital image.
- Restored photograph and framed print — the same file, plus a framed print shipped free.
Both include a restoration back within 24 hours, three rounds of changes, and the guarantee in section 8.
Restoration is craft, not a mechanical process. We say what we can do before you pay if you ask us first, and we would rather turn a photograph down than take money for a disappointment.
3. Prices
Both offers are priced on the product page and at checkout. Prices are shown in US dollars and include our work and, for the print, delivery. No VAT is added at checkout: the price you see is the price you pay.
We may change prices at any time. The price that applies to your order is the one displayed when you place it.
4. Placing an order
You choose an offer, attach your photograph, and pay. The order is formed when payment is confirmed, and we email you a confirmation at that moment.
You are responsible for having the right to send us the photograph you send. We assume you do.
5. Payment
Payment is taken at the order, by card, through Shopify Payments. We never see your card number.
6. How the work goes
- Your restoration comes back within 24 hours of your order.
- We email you a link to a page where it sits beside your original.
- You approve it, ask for a change, or ask a question. Three rounds of changes are included, and each comes back within 24 hours. A question never uses a round.
- Approving releases your photograph. If you ordered a print, it goes to press then — nothing is printed before you approve.
Your photograph stays available for one year after approval. After that we delete our copies.
7. Delivery
The photograph arrives by email and there is nothing to ship. Prints are made by Gelato and delivered in 6 to 15 business days counted from your approval — the print is made first, then shipped. Our shipping policy has the detail.
8. Our guarantee, and cancelling
If the result still is not what you hoped for after your three rounds, we refund you in full — print included, nothing to send back. You can also cancel for a full refund at any time before you approve. The refund policy sets out both, and the statutory right to withdraw that sits alongside them.
9. The guarantees the law gives you
Whatever this page says, you keep the guarantees French law gives every consumer. They cost nothing and they are not ours to reduce.
The guarantee of conformity — articles L217-3 and following of the Code de la consommation. You have two years from delivery to act if what you receive does not match what was described, and you may ask for it to be repaired or replaced before, if need be, a reduction or a refund. For the first two years you do not have to prove the fault was there from the start.
The guarantee against hidden defects — articles 1641 and following of the Code civil. You have two years from discovering a hidden defect, and you may return the item and be refunded, or keep it and be refunded part of the price.
To use either, write to contact@photomotif.com.
10. What we are answerable for
We are answerable for doing the work we sold you, properly. We are not answerable for a photograph being beyond saving when we told you so before you paid, nor for delays caused by the carrier once a print has left the printer, nor for an address entered wrongly at checkout.
Nothing here limits our liability where the law does not allow it to be limited.
11. Your photograph, and who owns what
Your photograph stays yours. So does the restored photograph: we keep no claim over it and we never publish or sell either. We will not show your photograph as an example of our work unless we have asked you and you have said yes. Our privacy policy says what happens to the photographs and for how long.
12. Personal data
Set out in the privacy policy.
13. If something goes wrong between us
Write to us first — most things end there, and quickly. If we cannot settle it between us, the courts remain open to you, and nothing on this page takes that away.
14. Which law applies
French law. If you are a consumer, this does not take away the protection of the mandatory rules of the country you live in.
